Mark Fatharly

Mark is a member of Kott Gunning’s Commercial Dispute Resolution and Business Advisory practice groups.

He has experience in a wide variety of commercial and general civil litigation, including successfully utilising alternative dispute resolution methods to resolve claims. His experience also includes defending criminal and health and safety prosecutions, and prosecuting regulatory offences. He has had the conduct of matters as barrister and solicitor in a wide range of Courts and Tribunals. The nature of those matters has included inheritance, contractual, leasing and business disputes, trade practices issues, debt recovery, liquor licensing and compliance with professional obligations.

Mark also provides commercial compliance advice and training, and has advised clients on Year 2000, Trade Practices Act, Privacy Act, Financial Services and Uniform Credit Code and other compliance issues. That work has involved Mark in writing compliance opinions and advice, conducting compliance programs, presenting seminars and conducting training workshops for staff of clients. His clients in this area have included Homeswest, West Coast College of TAFE and United Credit Union. Through Kott Gunning's involvement in Network Law, Mark provides services to Credit Unions.

Mark has also previously had a paper published in an international legal journal on international sale of goods law. He is a member of the Australasian Compliance Institute, the Law Society of Western Australia and an Affiliate of the Australian Credit Union Institute.
