During the course of his employment, Mr Williams fell from the top step of a stepped walkway or pathway – but not a staircase – and in doing so, sustained injury to his left elbow and wrist. The Court found the Wollongong City Council had failed in its duty of care to take precautions to mark the hazard presented by the stepped walkway.
